1. Definition

1.1. Client: counterparty of Ready VPS, hereinafter referred to as the client.

1.2. Services: the services leased by the client from Ready VPS are set out in the (online) order (also referred to as the contract).

1.3. Terms of Service: the terms of the general terms and conditions, as well as the company's policies and guidelines explaining in which cases the services set out in the terms of service may be used (hereinafter referred to as the'TOS').

2. Сервісні збори

2.1. For using the services, the customer pays Ready VPS the current service fee specified in the order (online).

2.2. All prices are shown in euros excluding VAT, as well as excluding third-party payments (for example, transaction fees from a bank or (online) payment provider), as well as any other taxes or duties levied by the government. Services are paid for by the client in this currency, unless otherwise specified.

2.3. Ready VPS has the right to change tariffs. The client has the right to terminate the contract if he does not agree with this.

2.4. Payment (based on prepayment) must be made within seven (7) days from the invoice date in the manner determined by Ready VPS.

2.5. If there is no service fee, the service is suspended. Funds are expected to be received to extend the service.

2.6. Ready VPS reserves the right to delete the service if it was stopped for non-payment, and if the amount was not received during the rental period to continue the service. In this case, Ready VPS reserves the right to remove the stopped service. If there is no payment, the service is deleted after 7 days.

3. Term of the agreement. termination of the agreement

3.1. The contract is concluded for a certain period, unless the nature or content of this agreement provides for an indefinite period.

3.2. Upon expiration of the contract, it is extended for the following terms equal to the original term, unless one of the parties notifies the other party in writing that it does not agree to the extension of the contract, taking into account the notice period of at least one (1) day.

3.3. Ready VPS has the right to (partially) suspend the performance of its obligations or terminate the contract if:

  • The customer does not fulfill its obligations under the agreement or does not fulfill them in full or on time;
  • after entering into a contract, Ready VPS, based on the information it has received, has every reason to fear that the customer will not be able to fulfill its obligations;
  • has good reason to fear that the customer will not be able to fulfill its obligations.

3.4. Upon termination or expiration of the agreement:

  • Ready VPS must stop providing all services;
  • Ready VPS has the right to erase and delete all client data from Ready VPS hardware;
  • Ready VPS has the right to make the equipment available for use by other customers;

3.5. Ready VPS has the right to unilaterally amend (partially) the agreement and its accompanying documentation. This fix also applies to existing services, unless Ready VPS has stated otherwise. The correction takes effect on the application or on a later date specified in the application.

3.6. Ready VPS has the right to suspend the account if the user is inactive for more than 12 months.

4. Use of services

4.1. It is forbidden to engage in attacks on passwords by direct brute force, port scanning, spam (scripts designed to send messages to forums, chats, feedback forms, email, etc.), support for hacking, hacking, phishing, and other illegal actions on the Internet.

4.2. Storing any type of computer viruses in the provided disk space is prohibited.

4.3. Cryptocurrency mining is prohibited.

4.4. When ordering a service with a test or trial period, Ready VPS reserves the right to terminate the provision of services and delete the server in case of any inactivity on the part of the client.

4.5. It is forbidden to use the services for DDoS attacks or other malicious purposes.

4.6. Ready VPS reserves the right to limit the channel speed to 10-100 Mbit / s or block the server in case of high network activity for a long period of time, which leads to a load of network equipment exceeding 90%, or in case of exceeding the traffic limit of 10TB for VPS.

4.7. Ready VPS reserves the right to restrict or block the operation of the virtual server, in case of high load for a long period of time, exceeding 90% on the processor, which leads to a load on the server equipment, if the situation is not resolved by the client for the better (changing the tariff plan to a higher one or optimizing/removing scripts that cause heavy loads).

4.8. All complaints received are forwarded to the client, and a deadline for response is provided. If the server was stopped due to a violation complaint and no action was taken to resolve the issue within 7 Days, Ready VPS has the right to release/delete the server.

4.9. Ready VPS has the right to refuse to provide services to the client if, according to Ready VPS, the customer's content or software performs illegal, indecent, threatening actions, or violates UPU data in any form. Access to the service may also be restricted. The service can be stopped or removed from the ready VPS hardware with a notification to the client.

4.10. It is forbidden to broadcast copyrighted materials (broadcasts of TV channels, IPTV, live broadcasts, sports events) without the appropriate permission from the copyright holder.

4.11. It is forbidden to place online casinos, slot machines and any gambling games without a corresponding license.

5. Other provisions

5.1. In accordance with the current legislation on personal data protection, the client's personal data is confidential.

5.2. The client is obliged to fill in personal data truthfully and in full (name and country of registration).

5.3. Ready VPS reserves the right to suspend the provision of services and may terminate the client's right to access the service to perform maintenance.

5.4. The client acknowledges that the Ready VPS will perform (emergency) maintenance from time to time to ensure the proper functioning of the network, data center, and services, and acknowledges that such maintenance may affect the provision of services to the client.

5.5. Ready VPS reserves the right to move services, as well as the right to (temporarily) suspend services in connection with such movement.

5.6. Ready VPS does not guarantee the availability of services and does not guarantee that the software or any other materials do not contain system errors. Ready VPS makes all reasonable efforts and measures to prevent this.

5.7. Ready VPS is not responsible for direct or indirect damages caused to the client as a result of using or not being able to use the services, or is responsible for losses caused as a result of errors, omissions, downtime, file deletion, defects, delays in processing or transmitting data, changes in functions, or other reasons. Ready VPS does not guarantee that the client's email will be received from remote networks whose IP addresses are blacklisted and ignored by the Ready VPS mail client.

5.8. Ready VPS is not responsible for the quality of the public channels used to access the services.

5.9. The client assumes full responsibility and risks associated with the use of internet services, including responsibility for evaluating the accuracy, completeness and usefulness of any opinions, ideas and any other information, as well as the quality and properties of products and services distributed on the internet and provided to the client through these services.

5.10. The client is fully responsible for the security of their password and for losses that may arise as a result of its unauthorized use. In case of theft of the username and password due to the fault of third parties, the client has the right to send a request to Ready VPS to change the username and password with the mandatory attachment of the corresponding financial document confirming payment for services.

5.11. Ready VPS is not responsible for the actions of third parties that caused the theft.

5.12. Ready VPS is not responsible for notifying any third parties of the termination of access to the client's services and for possible consequences arising from the absence of such a warning. Ready VPS executes client requests sent only from the client's contact email address or from the service area (current account) on the official Ready VPS website. The email address specified during registration on the official Ready VPS website is considered a contact email address. The client can request a change of contact email address in the registration database from the service area (personal account) on the official Ready VPS website.

5.13. All information about the payer provided by the ready VPS client must be complete, truthful and accurate.

5.14. The client guarantees that the cryptocurrency used to pay for Ready VPS is of legal origin, freely sold and transferred, and has no connection with criminal activity, money laundering, or terrorist financing.

6. Refund

6.1. If the client refuses the services provided within 30 days from the start date of using the services, Ready VPS takes actions to refund unused funds, if the account is not blocked for violating the terms of the UNP, and the software license or server rental is not ordered. Otherwise, Ready VPS will not refund unused funds.

6.2. When returning funds, discounts activated when paying for services are taken into account, i.e. only the amount actually paid is returned (without bonuses, etc.).

6.3. Refunds are made within 30 days by the method chosen by the company.

6.4. Any third-party payment (gateway) or transaction fee is also deducted from the refund amount.

6.5. If due to the fault of the client to whom the funds were returned, the company suffers losses (disconnected Servers, Networks, a blacklist of IP addresses, etc.), the amount of expenses is deducted from the returned amount depending on each specific case.

6.6. No refund is made if the services are blocked due to violation of this agreement.

6.7. No refund is made if the service failure is caused by the following precedents:

  • force majeure;
  • act of the customer, its employees, end users or contractors;
  • any waiver of the terms and conditions controlled by the client;
  • tests, maintenance, or relocation;
  • suspension of the provision of services in accordance with the agreement;
  • any exercise by Ready VPS of its rights under the agreement;
  • any use of the service contrary to the agreement;
  • failure of the client to comply with the recommendations or solutions recommended or provided by Ready VPS;
  • any improper or unauthorized use of the service or use of the service for purposes for which it was not intended;
  • any interaction between the service and any other third-party software, hardware, or service;

6.8. No refund is made if the payment was made using Cryptocurrency, PayPalych or Enot, due to the specifics of the payment system.
